Lottie L. Bash and Christopher K. Kinnison won two motions for summary judgment resulting in dismissal of all claims brought by two separate plaintiffs against a fast food restaurant.

Plaintiffs alleged that a physical altercation on the restaurant’s premises was the responsibility of the restaurant because of the incident occurred on the restaurant’s premises and/or involved one of the employees.  The Court disagreed with plaintiffs’ contentions, found that the altercation was not employment rooted and granted the two summary judgments.  One of the plaintiff’s claims included a claim for disability.
