Brown wins Reversal of Trial Court in Timberland Access Dispute

May 05, 2009

Raymond L. Brown, Jr. obtained a judgment from Louisiana’s Third Circuit Court of Appeal reversing a summary judgment rendered against the owners of timber and hunting land seeking to protect their rights.  A series of wrongful and criminal acts interfered with access rights owned by Brown’s clients, whoclaimed they should be able to use their right of passage without interference.

The appellate decision allows the case for injunctive relief and damages to proceed to trial against the owners of the property over which the right of passage exists.
