Drell and Mathews Successfully Prosecute Intervention in Federal Bid Protest for Legacy EMS

In 2023, long-time firm client Legacy EMS, f/k/a MedExpress Ambulance Service, was the successful bidder to provide ambulance services for the Air Force Academy in Colorado.  The incumbent contractor, Asteri, protested the contract award on assorted grounds, which changed throughout the course of its protest. 
 
Bradley L. Drell and Heather M. Mathews successfully represented Legacy at the GAO, and Asteri’s bid protest was denied.  Asteri then filed suit in the United States Court of Federal Claims (COFC) in Washington, D.C., to further protest the award.  Drell and Mathews collaborated on the intervention in the COFC, which included oral argument before Senior Judge Loren Smith on cross-motions for judgment on the administrative record filed by Asteri, the United States, and Legacy.  Legacy will begin serving the Air Force Academy on April 1, 2024. 
 
This marks Drell’s second bid protest intervention in the COFC, both of which have been successful.  Drell commented, “I am extremely proud of our firm’s continued expansion into obscure matters in remote forums.  A win on behalf of any client brings joy, but I am particularly pleased to assist Legacy EMS in its service of our armed forces.”
