Firm attorney, Bradley L. Drell, served as a panelist for a special webinar hosted on June 9 by the American Bankruptcy Institute.  The media webinar focused on the ramifications of the U.S. Supreme Court’s June 6 decision in Siegel v. Fitzgerald, and can be viewed here

Notably, Drell serves as lead counsel for plaintiffs in the matter of Acadiana Management Group, LLC, et al. v. U.S., lodged in the U.S. Court of Federal Claims. This proposed class action has risen to prominence in recent weeks, as it seeks refund of increased Chapter 11 quarterly fees held by Siegel to violate the Bankruptcy Clause.

Other panelists included the former Director of the Justice Department’s U.S. Trustee Program and members of the bench and academia, with ABI Editor-at-Large Bill Rochelle serving as moderator.  Drell observed, “it is important that members of the bench and bar understand that not only were non-uniform fees imposed, but also political maneuvering led to the dual bankruptcy systems.  A spotlight has been shown on both the underlying circumstances and disparate effects of the dual systems, which cannot be ignored.”
