Gold Weems Employment Law Team Obtains Dismissal of Discrimination Suit Against Hospital

March 22, 2021

The Gold Weems Employment Law team comprised of Steven M. OxenhandlerMichael J. O’Shee, and Martha R. Crenshaw successfully defended Rapides Regional Medical Center (“RRMC”) in federal court in a race discrimination claim.

RRMC discharged Denise Veal (“Veal”) in April 2017 for poor work performance.  Shortly thereafter, Veal filed a Charge of Discrimination against RRMC with the Equal Employment Opportunity Commission.  Then, in January 2019, Veal filed a federal law suit against RRMC alleging race discrimination under Title VII of the Civil Rights Act.  The parties engaged in extensive discovery during which time Gold Weems team developed overwhelming evidence of legitimate, non-discriminatory reasons for termination supporting a Motion For Summary Judgment (“MSJ”) on Veal’s claims.  Michael O’Shee crafted RRMC’s Memorandum in Support of Summary Judgment.  Faced with the evidence as developed by the Gold Weems Employment Law attorneys, Veal chose not to file an Opposition to the hospital’s motion, but instead filed a Voluntary Motion to Dismiss all her claims, with prejudice, which the Federal District Court granted on 3/22/21, terminating the litigation.
