Gold Weems Employment Lawyers Prevail in OSHA Case

Gold Weems’s Employment Litigation Team (Steve Oxenhandler, Martha Crenshaw, and Joshua Dara, Jr.) recently prevailed for an industrial manufacturing client on a whistleblower complaint filed with the Occupational and Safety Health Administration (“OSHA”).  After being discharged by AFCO Industries for non-performance of duties, the employee filed an OSHA complaint alleging he was harassed and terminated for voicing safety concerns and filing a Safety and Health complaint against AFCO.

After a lengthy investigation and hearing, U.S. Department of Labor on September 21, 2016, issued its decision rejecting the employee’s retaliation claims and affirming that AFCO’s decision to discharge the employee was for legitimate non-discriminatory reasons.
